  • Can I, the buyer of a home, go beyond my Realtor and speak to the sellers agent?

    This home is a short sale, and we were told by the sellers agent ( her mother) also that the second mtg company approved our offer. When closing date came last week it was postponed due to the fact that there is no approval from 2 mtg. Now I guess there was never an approval from them, and that is something that she is working on now. I'm completely fed up with the whole situation.This has been ongoing since Feb. 4.

  • It would be very foolish to do so, do not interfere with the sale. This will bite you, you can only mess things up by by-passing your agent. The sellers agent should refuse to talk to you, but many are unethical and will see this as their opportunity to take advantage of you.

  • You need to go past the question asked and consider if this sale will ever happen. Second mortgage holders have very little incentive to take a short sale as usually the short will not cover the first and the second will get zip. If they agree to the short they will take a total write off and forgo any recovery options. My guess is this deal will never happen and you need to move on and find a house you can get into. You have already been lied to why stay around and get stonewalled any further.

  • No law restricts you from doing this. Your agent will probably still get paid. Most of the time when I have seen buyers do this they regret it because they say something that they thought was perfectly innocent but it costs them a lot of cash or aggravation later. That seller and their agent is not looking out for your best interest- they want to try and find out something that will help them even if it hurts you.

  • Yes, but remember, they work for the seller and not you, they have very limited disclosure to you.

  • Yes, but make sure it is "subject to contract".
